During my work with Ron and MortgageBrokerStore.com, we’ve dealt with many unique situations involving Power of Sale and Foreclosure actions. These legal remedies are available to mortgage lenders that allow them to reclaim their investments. In Ontario, when a person fails to make a mortgage payment, their lender will typically use the power of sale process to evict the occupants and sell the property. When the lender sells the house, the former owner is entitled to the profit from the sale when all fees are paid. Foreclosure is much less common in Ontario but allows a lender to take full ownership of the mortgaged property.
In both cases, the homeowner will lose money since lenders typically charge very high fees and may not sell for the highest and best value.
