These legal remedies are available to mortgage lenders that allow them to reclaim their investments. In Ontario, when a person fails to make a mortgage payment, their lender will typically use the power of sale process to evict the occupants and sell the property. When the lender sells the house, the former owner is entitled to the profit from the sale when all fees are paid.
